1. Introduction
Welcome to LA WEB PRO. These Terms of Service ("Terms") govern your use of our website and services. By accessing or using our website, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the website or use our services.
2. Services
LA WEB PRO provides web development, design, and digital marketing services. Our services include, but are not limited to, website design and development, graphic design, SEO optimization, and digital marketing solutions.
3. Project Agreements
All projects require a formal agreement between LA WEB PRO and the client. This agreement will outline the scope of work, timeline, deliverables, and payment terms. Work will not commence until the agreement is signed and any required initial payment is received.
4. Payment Terms
Payment terms are as follows:
- A non-refundable deposit of 50% of the total project cost is required before work begins.
- The remaining balance is due upon completion of the project and before the final deliverables are provided.
- For ongoing services, monthly payments are due on the 1st of each month.
- Late payments may incur a fee of 5% per week.
- We accept payments via CashApp ($androidextractions) and other methods as specified in your project agreement.
5. Intellectual Property Rights
Upon full payment, the client will own the rights to all final deliverables created specifically for their project. LA WEB PRO retains the rights to:
- Display the work in our portfolio, case studies, and other promotional materials.
- Reuse non-custom components, code, and design elements.
- Claim authorship of the work.
The client is responsible for ensuring they have the proper rights to all content they provide for the project, including text, images, logos, and other materials.
6. Project Timeline and Revisions
Project timelines will be outlined in the project agreement. Delays caused by the client (such as delayed feedback or content provision) may result in project timeline extensions.
The number of revisions included in a project will be specified in the project agreement. Additional revisions beyond this number may incur additional charges.
7. Termination
Either party may terminate the agreement with written notice if:
- The other party breaches a material term of the agreement.
- The other party becomes insolvent or bankrupt.
If the client terminates the project after work has begun, they will be responsible for payment for all work completed up to the termination date. The initial deposit is non-refundable.
8. Limitation of Liability
LA WEB PRO will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services or website.
Our total liability for any claims arising from the services provided will not exceed the amount paid by the client for the specific project or service that is the subject of the claim.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of any significant changes. Your continued use of our website and services after such modifications will constitute your acknowledgment of the modified Terms and agreement to abide by them.
